Corporate Counsel Introduces New Blog from Rich Baer
to Address Strategic Challenges Facing In-House Counsel

NEW YORK (March 14, 2011)- Corporate Counsel today announced the launch of the first blog on its Web site, written by Rich Baer, the well-known general counsel and chief administrative officer of Qwest Communications International, Inc. The blog will be updated one-to-two times each week.

To read the blog and find more information on Corporate Counsel, visit corpcounsel.com.

Titled “Reliance on Counsel – Tips, tech, theories and tall tales of an accidental general counsel,” Baer will focus on two areas of interest: the leadership and strategic issues with which general counsel are currently grappling and the role of outside counsel as viewed through the lens of a corporate client. Known for his desire to bring about change in the practice of law, Baer will also discuss how he does his job in his own legal department at Qwest, current events that are interesting to him and to his readership and ways he believes the practice of law should be restructured.

“Leaning on his 27 years of experience spanning from prosecuting homicides in Brooklyn, New York, to chairing a litigation department at a large law firm in Denver, Colorado, and his current role at Qwest Communications, Baer brings to this new blog vast knowledge and a snarky personality that makes him well suited for the blogosphere,” said Anthony Paonita, editor-in-chief of Corporate Counsel.  “We are very excited to start this new project with such an iconoclast in our niche area of law and are confident our readers will thoroughly enjoy his insights.”

Under Baer’s leadership, the Qwest legal department was named the legal department of the year in 2008 by Corporate Counsel magazine, one of the Ten Most innovative Law Departments in 2010 by Inside Counsel magazine, the Minority Corporate Counsel Western Region Employer of Choice, the recipient of the Outstanding Corporate Commitment Award by the Colorado Hispanic Bar Association and the recipient of the Donald W. Hoagland Award by the Colorado Bar Association for the law department’s pro bono work.

Baer earned a Bachelor of Arts degree from Columbia University and a Juris Doctorate degree from Duke University.

The American Lawyer’s March Issue: Litigating
Proposition 8; Norton Rose’s Global Ambitions;
and a Bingham Partner’s Unfortunate Mistake

NEW YORK (March 1, 2011)- The March issue of The American Lawyer covers Perry v. Schwarzenegger, the lawsuit that may shape the future of same-sex marriage in California. Additionally, readers will delve in to major changes at Europe’s Norton Rose. Finally, the March issue takes a look at an error that a Bingham McCutchen partner made in preparing the marital property agreement for Frank and Jamie McCourt—the owners of the L.A. Dodgers. To access these stories and more, visit www.americanlawyer.com.

“This month’s issue takes our readers inside Norton Rose, the London-based firm that has gone through a paradigm shift while playing catch up with their competitors,” says Robin Sparkman, editor-in-chief of The American Lawyer.  “The story gives our readers an in-depth look at what the firm has done to come back from two terrorist bombings in the early 1990s.”

In “Marriage Brokers,” Senior Reporter Ross Todd takes us inside Perry v. Schwarzenegger, a groundbreaking lawsuit that puts together two of the country’s best-known lawyers together.  Theodore Olson of Gibson, Dunn & Crutcher, who represented George W. Bush in Bush v. Gore, and David Boies of Boies, Schiller & Flexner, who represented Al Gore in the same proceeding, have wanted to work together for some time.  When the case against Proposition 8 presented itself, they jumped at the opportunity.

In late 2008, after meeting with Chad Griffin, a Los Angeles political strategist, Ted Olson decided to help him try to strike down California’s Proposition 8 and quickly brought on David Boies to assist. The story details the two lawyers’ professional collaboration and their groundbreaking work on the controversial lawsuit.

“Taking On The World” shows American Lawyer readers the rebuilding of London-based firm Norton Rose.  Chief European Correspondent Chris Johnson tells the story of the firm, once in near ruin after two terrorist bombings by the Irish Republican Army in the early 1990s, building itself up through CEO Peter Martyr’s brokering of alliances with law firms in Australia, Canada and South Africa. The deals have helped Norton Rose increase revenue and the firm’s global presence.  What’s next?  Finding a suitable U.S. firm to join the party.

In “Error at Home,” Senior Reporter Drew Combs takes readers inside the contentious divorce between Frank McCourt, the owner of the Los Angeles Dodgers, and his wife Jamie. Mrs. McCourt filed for divorce in 2009. As the divorce proceedings got underway, an error by the couple’s Bingham McCutchen attorney quickly came to light. That error, which involved a drafting mistake in the couple’s marital property agreement, has come to play a central role in the McCourts’ divorce proceedings.

Practices For Small And Midsize Law Firms

NEW YORK (February 10, 2011)-ALM Legal Intelligence, a leading source of business intelligence for the legal profession, today released its 2011 report on billing rates and practices for attorneys in small and midsize firms. Law practices around the country are starting to make the slow climb back from the depths of the recession. The national average hourly billing rate for attorneys rose 4.6 percent to $295 in 2010. The report focuses on billing practices based on factors including firm size, geography, practice area and years in practice. For more information, visit www.almlegalintelligence.com.

Data is extracted from The National Law Journal’s Survey of Law Firm Economics, a comprehensive annual review of the legal profession’s financial and economic performance that provides one of the most complete, accurate and up-to-date sets of industry economic data available.

The region with the highest average billing rate was once again the Northeast ($330), up 9 percent from 2009, followed by the West region ($298), up 8 percent from the previous year.  Lawyers in large metropolitan areas reported the highest average hourly billing rates nationally, led by New York ($380) and Washington, D.C. ($374).  On a national level, the specialty practice areas with the highest average hourly billing rates were commercial litigation ($398), followed by general law ($303) and insurance defense litigation ($199).

A total of 176 law firms participated in The National Law Journal’s Survey of Law Firm Economics, 2011 Edition, providing usable standard hourly billing rate data for 10,913 lawyers, including 3,712 associates, 6,236 partners/shareholders (equity and non-equity), 608 active counsel and 357 staff lawyers.  Additional information can be obtained by contacting almlegalintel@alm.com or calling 1-888-770-5647.

The American Lawyer’s February Issue: Lateral Partner Moves,
Law Firm Partners’ Job Satisfaction and the Big Move to China

NEW YORK (January 28, 2011)-The February issue of The American Lawyer covers the ten-year low in lateral moves that we saw in 2010. In addition, the February issue reports the few big moves that some attorneys did make from law firms and the public sector, a groundbreaking compensation survey and the way in which Chinese law firms are attracting top Western talent to their ranks. To access these stories and more, go to: www.americanlawyer.com.

“This month’s issue has an interesting look at Chinese firms and why Western attorneys are making the jump outside of their comfort zones to those firms,” says Robin Sparkman, editor-in-chief of The American Lawyer.  “This is a trend we are going to keep a close eye on over the next year, because it doesn’t seem to be slowing down.”

In “Staying Put,” Victor Li takes a look back at 2010 and how many lateral moves we didn’t see.  In the 12-month period ending September 30, 2010, only 2,014 partners had left or joined Am Law 200 firms, a decrease of 27 percent from the same period one year earlier.  One contributing factor?  A decrease in litigation as companies realized they were not in a strong place financially for prolonged lawsuits.

In “Lateral All-Stars,” D.M. Levine and Claire Zillman show us that while most partners stayed put, there were some major moves made in 2010.  The most significant partner moves of the year included impressive acquisitions by firms such as: Davis Polk, DLA Piper, Fulbright & Jaworski, Latham & Watkins and Sullivan & Cromwell.  In addition, Skadden, Arps, Slate, Meagher & Flom lured two high-profile government attorneys and Lowenstein Sandler welcomed an attorney with close ties to Bernard Madoff.

“How’m I Doing?” tells The American Lawyer readers about a groundbreaking new compensation survey that took a look at partners’ satisfaction with their wages.  Major, Lindsey & Africa partnered with ADF Research and sent a compensation satisfaction survey to 30,000 law firm partners across the country.  Nate Raymond tells us respondents in New York reported earning more than in any of the other 10 cities surveyed, but partners in six other cities said they bill more hours than their counterparts in Manhattan.  Also, partners were more satisfied with their compensation in firms with open compensation systems compared to those at a firm with a closed system.

In “China from the Inside,” Anthony Lin takes a close look at the new trend of Western partners making the once unthinkable move to Chinese law firms.  Over the past several months, a new wave of American partners and other senior lawyers have moved to Chinese firms, following associates, especially those of Chinese origin, who began making the switch years ago.  The move is ideal for both sides: Chinese firms that take on Western lawyers can deepen and expand relations with multinationals while the switch makes it possible for Western lawyers to preserve a vibrant Chinese practice.  Simply put, Chinese firms have more work.

The switch also benefits American companies who do a large volume of business in China.  One partner who made the move to a Chinese firm estimates his hourly billing rate dropped by over 40 percent once he moved to a local shop.    In addition, Chinese firms have practicing Chinese lawyers, a bonus that Western firms lack.
