ALM’s Law Journal Press Announces Publication
of New Book Regarding Appellate Practice
in Federal and State Courts

NEW YORK (September 29, 2011)-ALM’s Law Journal Press, a leading publisher of print and digital publications for legal professionals, today announced the publication of “Appellate Practice in Federal and State Courts” edited by David M. Axelrad with Contributing Experts.

Written for both novices and veteran practitioners, this complete guide offers insights on legal and practical considerations at each stage of the appellate process, from preserving issues for appeal to post-appeal proceedings. It is available in print and in an online edition, enhanced for the Web and mobile devices. A detailed table of contents, as well as ordering information for this and other Law Journal Press publications, is available at www.lawcatalog.com.

Appellate Practice in Federal and State Courts features a preface by the Honorable Ruggero J. Aldisert, Senior U.S. Circuit Judge, U.S. Court of Appeals for the Third Circuit. Judge Aldisert writes, “It should find a place in every court or bar association library; and certainly in the library of a firm or lawyer whose practice brings him or her to appellate courts.”

Topics covered include the decision to appeal; standards of review; standing to appeal; timely filing; how courts view the “Record on Appeal”; appellate motion practice; using amicus briefs effectively; preparing persuasive appellate briefs and oral arguments; review by courts of last resort; the use of information technology in appellate courts; and how to develop and market an appellate practice.

Axelrad, a California State Bar Certified Appellate Specialist and partner with the civil appellate law firm of Horvitz & Levy LLP, has handled hundreds of civil appeals in state and federal courts in his nearly thirty years of appellate practice. He has been an Assistant to the Director of the FTC’s Bureau of Consumer Protection and a Staff Attorney for the U.S. Court of Appeals for the Ninth Circuit. Axelrad writes and lectures widely on the appellate process and is currently an Adjunct Professor at Loyola Law School in Los Angeles.

Law Journal Press, a division of ALM, publishes more than 130 books, in print and in digital online and mobile formats, on a broad range of legal and business topics. Written by leading lawyers and experts and updated regularly, Law Journal Press editions offer definitive and timely information, insightful analysis and practitioner-oriented guidance for the legal profession.

The American Lawyer Publishes Global 100 Survey,
Finds Past Data Questions Necessity of Going Global

NEW YORK (September 29, 2011)- Along with its annual Global 100 survey of the world’s largest law firms, the October issue of ALM’s The American Lawyer, also available on americanlawyer.com, includes a 12-year historical analysis suggesting that international expansion is not a requirement for increased firm profitability.

“For our top 50 firms in 1999 — the first year that we published profits per partner data for what was then the Global 50 — the proportion of lawyers employed outside each firm’s home country doubled by 2010, while profits per partner more than doubled,” writes ALM senior international correspondent Michael D. Goldhaber. “But whether there is a causal relationship between global expansion and financial success is unclear. Star performers may be found among the most stubborn homebodies, like Slaughter and May, and the most persistent imperialists, like Allen & Overy.” Nevertheless, expansion has been the rule, with only 28% of the extant 1999 firms remaining “homebodies” (defined as no more than 10% of lawyers practicing outside their home country) compared to two-thirds at the time.

The new Global 100, ranked by gross revenue, is topped by U.S.-based Baker & McKenzie, Skadden, Arps, Slate, Meagher & Flom, and DLA Piper, but UK-based Clifford Chance, Linklaters, Freshfields Bruckhaus Deringer, and Allen & Overy fill slots five through eight. In terms of profits per partner, Wachtell, Lipton, Rosen & Katz, Quinn Emanuel Urquhart & Sullivan, Sullivan & Cromwell lead, with only the UK’s Slaughter and May in eighth place preventing a U.S. sweep of the top 10.

Though none of the Global 100 are Icelandic, that nation’s lawyers are the focus of a major feature in The American Lawyer‘s October issue – “Ice Storm” by Julie Triedman – chronicling in detail their extraordinary efforts, aided by some foreign bankruptcy lawyers, to shepherd the banks that failed so spectacularly in 2008 toward an orderly restructuring.

Largest U.S. Corporations Spread the
Work Around to Hundreds of Law Firms,
According to New Survey by ALM’s Corporate Counsel

NEW YORK (September 28, 2011)-ALM’s Corporate Counsel, the nation’s leading publication for general counsel and in-house attorneys, reported the results of its 2011 “Who Represents America’s Biggest Companies” report on outside counsel in its October 2011 issue.

Morgan, Lewis topped this year’s survey, which is based on how many times a law firm is mentioned as a firm that is retained by a Fortune 100 company for various litigation services. Morgan, Lewis was followed by DLA Piper, Fish & Richardson, Fulbright & Jaworski, Littler Mendelson and Perkins Coie, Alston & Bird, Jones Day, Morrison & Foerster, Ogletree Deakins and Sedgwick.

In fact, Fortune 100 companies use hundreds of different law firms. Just over 650 different firms were named nearly 1,500 times as serving in one of four areas of litigation for the Fortune 100. Just over 400 of them were named only once. And contrary to popular belief, it’s not just big firms that get a piece of this business. More than three-quarters of the firms named are smaller firms that do not appear on the Am Law 200 list of the highest grossing firms.

But the firms mentioned most often are all megafirms. And while some of those names do change, many are perennial leaders. Morgan, Lewis, for example, which was tops in litigation overall, was also the most mentioned firm five years ago. In general, labor & employment lawyers get more than their share of court time. So do firms specializing in intellectual property: Fish & Richardson topped the list for IP Litigation this year and came in third on our overall most mentions list. It’s made regular appearances on our most-used firm list.

“If you’ve been paying attention to the industry buzz over the past couple of years, you would have thought that U.S. law firms would be struck by the tidal wave of the Great Recession, and that large corporate legal departments would drastically slash the number and frequency of law firms they retained,” said Anthony Paonita, editor in chief of Corporate Counsel. “The results of our survey indicate that this revolution, while ongoing, is still a work in progress.”

According to Paonita, that’s because while companies are trying to be more systematic in how they hire and work with outside law firms, “the practice of law remains a uniquely human enterprise, and personal relationships and comfort with a partner still count for a lot. And in-house lawyers have wide professional and personal networks.”

To determine which law firms represent America’s largest corporations, Corporate Counsel searched public records to find outside counsel used by companies in the Fortune 100 for corporate, contracts litigation, labor litigation, torts litigation and intellectual property.

Complete survey results are available online now at www.corpcounsel.com.
