PANEL TO EXAMINE PROGRESS OF 7TH CIRCUIT ELECTRONIC DISCOVERY PILOT PROGRAM AT LEGALTECH WEST COAST 2010 CONFERENCE

NEW YORK (June 3, 2010) – A panel including Hon. David J. Waxse, U.S. District Court, District of Kansas will discuss the progress of the 7th Circuit Electronic Discovery Pilot Program on June 23 at ALM’s upcoming LegalTech West Coast 2010. The Pilot Program was formed in May 2009 to reduce the burden and cost of electronic discovery in litigation pending in the federal district courts of Illinois, Indiana and Wisconsin. LegalTech West Coast 2010, the region’s largest and most prestigious legal technology conference and trade show, will take place June 23-24 at the Los Angeles Convention Center. Mauro received a bachelor’s degree in political science from Rutgers University, and a master’s degree from the Columbia University Graduate School of Journalism.  He is the author of “Illustrated Great Decisions of the Supreme Court” and has written law review articles and contributed chapters to several books, including “A Good Quarrel: America’s Top Legal Reporters Share Stories from Inside the Supreme Court.”  A winner of numerous awards for his Supreme Court coverage, Mauro is chairman of the executive committee of the Reporters Committee for Freedom of the Press and is a member of the advisory board of the World Press Freedom Committee and of The Media Institute. He is also on the advisory board for Georgetown University Law Center’s Master of Studies in Law program for journalists.

Coyle, who appears on a regular basis as a legal and Supreme Court analyst for the PBS NewsHour, joined the NLJ and began covering the Supreme Court in 1987.  Previously, she had covered state and national politics and government for the Allentown Call-Chronicle newspapers for nearly a decade. Coyle earned her bachelor’s degree from Hood College, a master’s degree in journalism from Northwestern University and a law degree from the University of Baltimore School of Law. She is a contributing author to “A Year in the Life of the Supreme Court” (Duke University Press) and has had articles published in The New York Times Sunday Book Review, Vogue, and Ms. magazines, among others. Her work has earned her the George Polk Award for legal reporting, the Investigative Reporters and Editors Award for outstanding investigative reporting, the Scripps Howard Neiman Award for environmental reporting and other national journalism awards.

THE AMERICAN LAWYER’S AM LAW 200 ISSUE: MID-SIZED AND REGIONAL FIRMS SEE KEY PROFIT AND REVENUE METRICS DROP, AS RECESSION COMES HOME TO ROOST FOR SMALLER FIRMS

NEW YORK (June 1, 2010) – The June Am Law 200 issue of The American Lawyer reveals that the nation’s Second Hundred top-grossing law firms — which had outperformed the Am Law 100 on virtually every financial dimension in 2008 — stumbled in two key areas last year. Average profits per partner for the Second Hundred fell 0.3 percent, to $646,926, while The Am Law 100’s rose 0.3 percent. And, Second Hundred revenue per lawyer dropped 2 percent, to $575,855, a slightly worse showing than The Am Law 100’s 1.9 percent fall. The 2010 Am Law 200 rankings, based on FY 2009 financial performance data, are featured in the June issue of the magazine, available beginning today. Widespread cost reductions have taken place across the entire Am Law 200, and both groups now have nearly identical profit margins—37 percent at The Am Law 100 and 36 percent at the Second Hundred.  In 2009, however, it appears that the two groups started to diverge in the area of head count. Total head count grew 1 percent at the Second Hundred, while it fell 1 percent at The Am Law 100. The Second Hundred increased its equity partner ranks by 1.9 percent, while The Am Law 100 cut its by 0.7 percent.

“The bottom line: last year there was nowhere to hide,” said editor in chief Aric Press. “On average, Second Hundred firms, as a group, were just as vulnerable to the economic downturn as Am Law 100 firms were.”

There was some good news for the Second Hundred.  The Second Hundred’s fall in total gross revenue was smaller than The Am Law 100’s—1 percent, to $17.1 billion from $17.3 billion, compared to a 3.4 percent drop at The Am Law 100.  (The Am Law 100 accounts for 79 percent of the Am Law 200’s total gross revenue.)
And, there were even a few bright spots of actual growth. Fifty-five Second Hundred firms had year-over-year increases in profits per partner, and 44 had increases in revenue per lawyer. Second Hundred firms in the upper Midwest’s manufacturing belt performed well, especially firms based in Indiana, Michigan, and Ohio.

THE RECORDER TO EXPAND DIGITAL DELIVERY
OF LEGAL NEWS AND ANALYSIS
Redesigned and Expanded Legal Website and Weekly Newspaper to Debut June 7

CHARLES SIEGEL JOINS ALM’S BOARD OF DIRECTORS

Legal Departments at Discover Financial Services, Hewlett-Packard Company,and The Williams Companies Are Selected As Finalists in Annual Competition

NEW YORK (May 19, 2010) – –ALM’s Corporate Counsel today announced the selection of the in-house attorneys of Microsoft Corporation as winners of the magazine’s fifth annual “Best Legal Department” competition.  Corporate Counsel‘s editors also named the legal departments of Discover Financial Services, Hewlett-Packard Company, and The Williams Companies as finalists.  Profiles of the winner and finalists, including online video interviews, will be featured in the June issue of Corporate Counsel, out today, and on the magazine’s website at www.corpcounsel.com.

The in-house legal department at Microsoft was selected for achievements including the settlement of the company’s longest and most expensive antitrust legal battle, a fight with the European Union over opening its Windows operating system to rivals’ browsers.  Microsoft’s general counsel, Brad Smith and his legal team spent months last year hammering out the details of the 61-page settlement, including 24 videoconferences and 34 conference calls with lawyers representing EU regulators.  The settlement was a major win for a legal team which has set out to prove that it can resolve disputes amicably, despite Microsoft’s reputation for aggressively fighting legal disputes to their bitter end.

In addition to its settlement and litigation successes, the 459-lawyer group was cited for its steps to increase efficiency in the face of budget cuts, and for its diversity and pro bono efforts, including helping laid-off workers get free computer training and representing immigrant children in court.

“As always, the competition among the finalists was extremely tight, but Microsoft’s use of a conciliatory approach to bring resolution to a landmark case that had dragged on for years stood out,” said Anthony Paonita, editor in chief of the magazine.  “Equally important to our decision was the quality of their litigation and IP work, as well as their efforts to bring real diversity to their department.”

The magazine’s editors cited Discover Financial Service’s legal department – one of the smallest to ever enter the competition with just 34 members - for its creative problem solving and innovative use of staff.  For example, its tiny litigation team (just one full-time attorney and two part-time lawyers) handled over 1,000 legal matters in 2009, while resolving 11 of 14 pending class action suits. Working with
outside counsel, the team collected $2.75 billion last year from an antitrust suit it won in 2008 against Visa Inc. and MasterCard Incorporated. It was the third-largest antitrust victory in history.

The more than 400 lawyers in HP’s global legal team were recognized for work that included a complete overhaul of HP’s compliance system. That involved identifying close to 50,000 employees who dealt with the public sector side of HP’s business in 12 different countries, and making sure they had the right training to observe local corruption and bribery laws.  Under the leadership of general counsel Michael Holston, the group has helped the company recover from boardroom scandals that prompted the departure of the company’s CEO and previous general counsel and instituted a formal pro bono program, which is set to expand to encompass the company’s large staff of international lawyers.

At The Williams Companies, the legal department’s ability to analyze data and make projections helped it craft innovative fee agreements with its main law firms. Those deals have enabled Williams to cut its outside legal expenses by about 15 percent.  Led by general counsel Jim Bender, the 39 attorneys for the natural gas company were also recognized for implementing a new compliance program, including companywide training on compliance guidelines and procedures, and for developing a comprehensive approach to discovery that has saved the company millions of dollars.

Winners were selected from responses submitted to a detailed questionnaire developed by the editors and reporters of Corporate Counsel and distributed to the general counsel of all Fortune 500 corporations. The magazine’s editors and reporters evaluated submissions and selected the winners.

The winner and finalists will be honored this fall at a joint event with Corporate Counsel’s sibling publication The American Lawyer. The dinner will salute The American Lawyer’s Lifetime Achievement Award winners, the 20 firms from the Am Law 200 selected for the magazine’s “A-List,” and the winners and finalists of Corporate Counsel’s Best Legal Department competition.

NEW ALM LEGAL INTELLIGENCE STUDY INDICATES BROAD LAW FIRM STAFFING, BUSINESS MODEL AND OPERATING RESPONSES
TO ECONOMIC PRESSURES

NEW YORK (May 17, 2010)ALM Legal Intelligence, a leading source of business intelligence for the legal profession, today released a new qualitative study, “Changes In Staffing Structure of Law Firms,” that examines the impact of the current economic recession on large law firms. Based on in-depth research interviews with senior decisionmakers at Am Law 100/200 law firms across the country, the report indicates that law firms have taken a wide variety of steps to adjust their staffing, business and operating models, including reducing both partner and associate ranks; cost cutting and outsourcing; and increasing use of alternatives to traditional hourly billing arrangements. Among the findings of the study:

  • De-equitization of partners and continued growth of non-equity partnerships is seen as an ongoing trend.
  • Firms are actively exploring new approaches to associate hiring and promotion policies that offer more flexibility in adjusting staffing to economic conditions. Associates’ billable hour requirements, however, have not changed in the majority of firms despite the economy.
  • Due to economic pressure and lower demand, many top tier firms are reaching down for clients and projects. Some leading firms have been prepared to work at deep discounts or even for no fee in order to maintain market share and position.
  • Cost reduction on all operating business fronts is viewed as a priority, with cutbacks in travel, marketing and entertainment being initial targets. More firms are examining and implementing outsourcing programs as an important element of their cost reduction programs.
