NEW ALM STUDY REPORTS DECLINES IN TOTAL CASH
COMPENSATION FOR MANY IN-HOUSE ATTORNEY CATEGORIES

NEW YORK (September 14, 2010) – Median U.S. chief legal officer total cash compensation (salaries plus bonuses) decreased by almost 4 percent this year to $466,800, according to the 2010 Law Department Compensation Benchmarking Survey by ALM Legal Intelligence, a leading source of business intelligence for the legal profession. The losses almost exactly wiped out gains made by this same group last year. The study analyzed compensation data for almost 5,300 lawyers in 208 corporate law departments across the country. For further information, or to purchase a copy of the survey, visit http://www.almlegalintelligence.com.

While CLO median salaries and bonuses (for those receiving them) rose modestly, almost one quarter of the CLOs surveyed received no bonus this year. The downward trend in total cash compensation parallels results reported earlier this year in Corporate Counsel’s 16th annual survey of the 100 best-paid chief legal officers in the U.S.

“This is the first time we’ve reported a drop in median total cash compensation for CLOs since our 2000 survey,” said Kevin Iredell, vice president, ALM Legal Intelligence. “It’s now clear that general counsel across a wide spectrum of companies are not immune to the same cost-cutting pressure they’re applying to their outside firms.”

CLOs were among the six of nine in-house attorney job titles surveyed that saw total median cash compensation decline last year. However, the non-management attorney position was the only one of the nine to report a decrease in all three categories of compensation: salary (-5.36 percent) bonus (-4.46 percent), and total cash (-6.62 percent). Conversely, only three positions—division GC, high level specialist, and staff attorney reported increases in all three categories.

Three of four management titles realized an increase in salary from last year, while only two of the five non-management positions reported increases in salary.

Intellectual property and employee benefits are the most lucrative areas of specialization, with these attorneys reporting total 2010 cash compensation of $240,000 and $238,500 respectively.

This represents a premium of approximately 20 percent over the 2010 median total cash compensation for all high level specialists.

Approximately 75 percent of the organizations surveyed had more than $1 billion in sales revenue; almost half had more than 5,000 employees. Additional information on the survey can be obtained by contacting Kevin Iredell at (212) 457-9500/ kiredell@alm.com, or calling 1-(888) 770-5647.

THE AMERICAN LAWYER REPORTS MIDLEVEL ASSOCIATE
SATISFACTION DROPS TO LOWEST LEVEL IN SIX YEARS

Heavy Workloads, Reduced Staffing and Lingering Pay Cuts Rankle
Those Who Retained Jobs With Big Law Firms

NEW YORK (September 7th, 2010) –Despite retaining gainful employment in a recession and six-figure salaries, mid-level lawyers at the country’s largest law firms don’t feel lucky. In fact, The American Lawyer’s latest Am Law 200 midlevel associate satisfaction survey reveals that overall job satisfaction has dropped to its lowest level since 2004. This year, 109 of the 124 firms that participated in the survey this year and last year saw their average satisfaction ratings drop, while overall scores for 15 big American cities, including the major legal hubs where associates are located, show a downward trend as well. Reasons cited for the increased unhappiness included a failure to regain compensation levels lost to pay cuts in previous years, poor communication and a growing workload, exacerbated by staff cuts. For complete survey results and other stories, visit www.americanlawyer.com.

“This isn’t a happy time at large law firms. Partners are worried about their futures. The business models of some have been badly hurt. It’s no wonder that many associates who have seen their colleagues fired, their replacements deferred, and their bonuses disappear would be more unhappy,” said Aric Press, editor in chief of The American Lawyer.  “For all that many still reported gratitude for their jobs and their relative security.”

The unease felt by the group isn’t because they fear being pinkslipped.  In the 2009 survey, a whopping 83 percent of respondents expressed medium to high anxiety about losing their jobs, but this year nearly 80 percent of survey respondents said they were not worried about being laid off. And of the nearly 69 percent of respondents in this year’s survey who said their firms conducted associate layoffs, 47 percent believed they were spared because of the quality of their work.

Economic recovery may further underline the gap between these associates and their employers. The number of respondents who said they were looking for another job nearly doubled this year, to a little under 16 percent, from around 8 percent in 2009. And the number of respondents who thought they would still be at their firms in five years as an equity partner, nonequity partner, or counsel/senior associate, dropped 9 percent from last year, to just 35 percent.

For the third consecutive year, the 144-attorney Boston-based firm Nutter McClennen & Fish garnered the survey’s highest national ranking score.  Nutter McClennen scored well across the board, but its high rating of 4.42 regarding openness about the partnership process stood out.

Some of the biggest leaps in this year’s national ranking were made by large national firms.  Kelley Drye & Warren jumped 97 spots, to a rank of 26 on the 2010 survey.  Dewey & LeBoeuf made a similar leap, climbing 96 spots, to a ranking of 41. Paul, Hastings, Janofsky & Walker leaped 59 spaces, to the seventh position on the national rankings, while Latham & Watkins rose 57 spots, to a ranking of 22.  Texas-based Vinson & Elkins avoided associate layoffs and saw its ranking soar 41 spots, to twenty-third on the list.

The American Lawyer surveyed of 5,092 midlevel associates, attorneys in their third, fourth, and fifth years of practice.  The average composite score—which is based on ratings for 12 core questions—fell from 3.897 in 2009 to 3.728 this year.

CORPORATE COUNSEL RELEASES 2010 “WHO REPRESENTS AMERICA’S BIGGEST COMPANIES” RANKINGS

Latest Outside Counsel Survey Reveals That The Recession Has Led To Closer Client/ Law Firm Relationships, As Well As Cutbacks

NEW YORK (August 19th, 2010)Corporate Counsel, the nation’s leading publication for general counsel and in-house attorneys, today released the results of its 2010 “Who Represents America’s Biggest Companies” survey of outside counsel. Cleary Gottlieb topped this year’s Corporate rankings, while Bryan Cave led the list for Torts Litigation. In its cover story, Corporate Counsel reports that the recession has not just led to cutbacks in outside legal services and a push for alternative fee arrangements; company GCs and their law firms say it’s also spurred them to develop closer relationships. Complete survey results are available in the September issue of Corporate Counsel and on the Web at www.corpcounsel.com.

Other category leaders in the survey included Alston & Bird (IP Litigation), Baker Botts (Patent Prosecution), Greenberg Traurig (Contracts Litigation) and Morgan Lewis (Labor Litigation.)

In the cover story, “Getting To Know You,” Teri McClure, general counsel for United Parcel Service, Inc., says, “We invest a lot of time and energy into the relationship [with our outside counsel], and very much view it as a partnership.  There’s a much more collaborative approach now, and it has required more communication, more dialogue, and much more openness.”

“This survey gave us an opportunity to delve into the most important relationship for our readers,” added Anthony Paonita, editor in chief of Corporate Counsel.  “We found that the economic crisis, while altering the balance between outside and in-house counsel, has actually drawn them closer. Call it looking at a glass half-full, but it will probably outlast today’s business difficulties.”

As part of its outside counsel coverage, Corporate Counsel also profiles two of the boutiques that have earned a coveted spot on Microsoft’s roster of regular outside counsel: San Francisco–based Vierra Magen Marcus & Deniro, which has taken on a growing slice of

Microsoft’s cutting-edge patent work; and Washington, D.C.–based Wiltshire & Grannis, the company’s go-to firm for telecom-related regulatory matters.

To determine which law firms represent America’s largest corporations, Corporate Counsel searched public records to find outside counsel used by the Fortune 100 for corporate, contracts litigation, labor litigation, torts litigation, and intellectual property.  Sources include ALM Legal Intelligence, Thomson Reuters, PACER and the Patent and Trademark Office Web site.  The time period from January 1, 2009, to December 31, 2009, was used for all research.
