Important Update

ALM Media LLC (”ALM”) has embraced a larger digital presence over the past few months in order to provide its customers quality products and services at a faster pace. In order to create better products and build an enhanced experience for its customers, ALM has made some changes to the way it uses the information it collects. Therefore the Privacy Policy has been updated, and the new Privacy Policy is effective on December 23, 2013.


PRIVACY POLICY

This website is owned and operated by ALM Media, LLC (“ALM”), a Delaware limited liability company with offices at 120 Broadway, 5th Floor, New York, NY 10271. References to “ALM,” may be construed as references to ALM and its parents, subsidiaries, or divisions, including but not limited to, ALM Media Properties, LLC, ALM International, Ltd. and ALM Media Canada, Inc. ALM has adopted information management guidelines that define our customer and advertiser relationships. These guidelines disclose the privacy policies for this website (which shall include when any ALM website is accessed via the Internet, mobile or other device, and applications and sites affiliated with ALM products, collectively, the “Online Services”).

Changes to this Privacy Statement

From time to time, ALM may use customer information for new purposes not previously disclosed in this privacy notice. If ALM’s information practices change at some time in the future ALM will post the policy changes here to notify you of these changes and provide you with the ability to opt out accordingly. If you are concerned about how your information is used, you should check back to ALM’s website periodically.

WHAT INFORMATION DOES ALM GATHER AND/OR TRACK ABOUT YOU?

Personal Information

Free E-Mails: When you sign-up to receive free ALM e-mail information bulletins, ALM requires that you supply your name and e-mail address.
Registration for ALM Products: When you register to receive ALM products, including products from CLECenter.com, whether those products are free or paid, ALM requires that you supply your full name, e-mail address, contact information, and a unique subscriber ID. ALM may also require demographic information (e.g., whether you are an attorney and for what type of entity you work). Customers must also agree to the Terms of Use applicable to the product for which they are registering and the ALM User License Agreement. In some instances, ALM also collects credit card information to bill subscribers for premium products.

Credit Card Information: If you use a credit card to pay for an ALM product or CLE program, ALM may retain your credit card information in order to renew your account in the event you elect to renew your subscription. When ALM does retain credit card information, ALM keeps it secure and separate from other demographic information you may have provided. ALM does not share credit card information internally within divisions of ALM.

LinkedIn Log In

If you log in to ALM through your LinkedIn account, ALM will collect and store the following information (the ”Profile Data”):

  • Your Basic Profile (including first name, last name, headline)
  • Your full profile (including experience, education and skills)
  • Your contact information
  • Your e-mail address

ALM will only collect the Profile Data on a one-time basis, unless or until the Profile Data is updated by you (which updated Profile Date you hereby give ALM permission to subsequently collect). ALM will not sell to any third parties the Profile Data. At any time, you may request that ALM remove the Profile Data from its system by contacting Customer Service.

Other Non-Personal Information Collected Using Technology

ALM may also gather other non-personal information, which is any information that does not reveal your specific identity (i.e., browser information, information collected through cookies and other technologies, demographic information and aggregated information) and may be used by ALM or shared with third parties. This information does not personally identify you but may be helpful for improving the services ALM offers.

Cookies: “Cookies” give users a special, random ID which are small text files, which are stored on the hard drive of a user’s computer or device. ALM employs cookies to recognize you and your access privileges for certain locations on the Website as well as to track site usage. Subscribers who do not accept cookies from the Website cannot access many areas of the Website. ALM also uses advertising servers developed by third parties (currently Real Media 24/7, Google, and BBN to name a few) to display ads on the Website; however ALM reserves the right to work with other third party advertising networks on an as-needed basis. Some of these ads may contain cookies that are set by third parties (i.e., advertising agencies or advertising technology providers). ALM does not have access to these cookies or any information that they may contain. You may also set your browser to block all cookies, including cookies associated with ALM’s services. However, it’s important to remember that many of ALM’S services may not function properly if your cookies are disabled. For example, ALM needs first-party cookies to log you in to read stories that require registration or a subscription. In that case, you may set your browser to block third-party cookies and allow ALM’s first-party cookies only.

Device Information: ALM may collect non-personal information about the device (e.g. computer, mobile, e-reader, tablet) you use to access ALM’s services, including but not limited to IP addresses, geo-location information, unique device identifiers, browser type, browser language and other transactional information. If you access our Online Services from a device, ALM may collect a unique device identifier assigned to that device or other transactional information for that device in order to serve content to it.

IP Addresses: ALM also logs IP addresses for systems administration and troubleshooting purposes. (Your IP address indicates the location of your computer on the Internet.) ALM neither logs IP addresses to track your session nor links IP addresses to anything personally identifiable. ALM uses this information in an aggregate fashion to track access to ALM Online Services.

Analytics Technologies: ALM has hired third parties to provide ALM information, reports and analysis about the usage and browsing patterns of users of ALM products and services. Such third parties shall (i) track and analyze non-personally identifiable usage and volume statistical information about ALM visitors and customers with respect to ALM Online Services; and (ii) track and analyze anonymous usage and browsing patterns of users of ALM’s Online Services.

User History: ALM may log certain usage information about your use of ALM products, which may include a history of the pages you view. This information will help ALM to provide you with customized products or services. ALM may also use log files in the aggregate to analyze usage of ALM’s websites and mobile applications. If you download and use any ALM software application (either on a tablet or other mobile device), the log files will automatically be collected by the application and sent to ALM’s servers when your device syncs up for the latest content available.

Location: Certain ALM mobile applications may deliver content based on your current location if you choose to enable that feature of such application. If you choose to enable the location-based feature, your current location will be stored locally on your device, which the application will use. If you do not enable the location-based feature or if an application does not have that feature, the application will not transmit to ALM, and ALM shall not collect or store, location information.

“Do Not Track” Signals: At this time, ALM does not respond to browser “do not track” signals or other, similar, mechanisms.

California’s Online Privacy Protection Act: Except as otherwise disclosed in this Policy, third parties may not gather your personally identifiable information over time and/or across different websites when you use ALM’s Online Services.

WHAT DOES ALM DO WITH THE INFORMATION IT GATHERS AND/OR TRACKS?

ALM uses your personal and non-personal information that it collects from you and about you for the purposes set forth below. For the avoidance of doubt, ALM may use and disclose non-personal information for any purpose, except where ALM is required to do otherwise under applicable law. If ALM is required to treat non-personal information as personal information under applicable law, then ALM may use and disclose it for all the purposes for which ALM uses and discloses your personal information.

ALM uses the information it gathers about you (i.e., either information you provide or information/data acquired from third party sources that is appended to the information provided by you) to enable your use of ALM’s products and Online Services, including but not limited to e-newsletters, renew paid services, and participate in contests and message boards.

Statistical Analysis: ALM may perform statistical, demographic and marketing analyses of user behavior in order to measure interest in the various areas of ALM sites and their subscribing and purchasing patterns for product development purposes and to inform advertisers about ALM’s subscriber base. ALM uses such information for analysis purposes, which includes but is not limited to analysis to improve customer relations.

Customizing Your Products and Online Services: ALM uses the information that it collects to allow advertising and content to be targeted to the users for whom such advertising and content is most pertinent. ALM also uses the information that it collects to customize certain features of the ALM products and Online Services to provide you with an enhanced experience based on the type of device you are using to access the ALM products and Online Services, and in some instances, provide you with requested products and/or services.

Account Maintenance: ALM may utilize the contact information you provided at registration, such as your telephone number and e-mail address, to contact you regarding account status, changes to the subscriber agreement, and to confirm registration.

Marketing and Advertising: ALM may use marketing tools (such as cookies) to improve services to customers, including improving search results and tracking user trends. If you wish to opt out of such tracking, you may opt out now. If you delete the opt-out cookie, or if you change computers or Web browsers, you will need to opt out again. ALM also uses demographic information to allow advertising banners on ALM sites to be targeted to the readers for whom they are most pertinent. This means that readers will see advertising that is most likely to interest them, and that advertisers will send their messages to people who are most likely to be receptive, improving both the user’s experience and the effectiveness of the ads. ALM may use advertising networks to help present advertisements on ALM sites. These advertising networks use cookies to help present, better target, and measure the effectiveness of their advertisements, using data gathered over time and across their networks to determine the characteristics and preferences of their audience.

Service Updates, Promotions and Other E-mails: ALM reserves the right to send you e-mails regarding your account status, which shall include but is not limited to order confirmations, renewals/expiration notices, notice of any credit card issue, and/or other e-mails and notifications about new features or changes to the ALM products and/or Online Services. If you have registered to receive e-mail newsletters, you shall receive e-mails specifically for such newsletters. ALM may periodically send you e-mail messages about products and services that ALM or its partners think may be of interest to you. If you choose not to receive such e-mails, you may make such a selection upon registration or unsubscribe or opt-out from such e-mails (see below for instructions). If you use the “E-mail This Article” feature to e-mail links to articles, the e-mail that you supply to ALM may be saved for your convenience however the e-mail address provided to receive the link to the article shall not be used or shared for any other purpose. If you send ALM e-mails, you should be aware that any information provided in an e-mail may not be secure or encrypted and therefore may be available to others. Please exercise caution if you decide to disclose any personal or confidential information in such e-mail. ALM representatives shall use your e-mail address to respond to any of your questions or comments. ALM hereby acknowledges that it fully complies with the CAN-SPAM Act of 2003.

WITH WHOM DOES ALM SHARE THE INFORMATION IT GATHERS AND/OR TRACKS?

ALM takes the privacy of its customers seriously. You have the ability to control how ALM uses your personal information by informing ALM if you wish to opt-out of certain uses of your information, as described in greater detail in the ”Opting Out” provision below.

Third Parties: ALM may, on occasion, choose to share the personal information collected about subscribers with select third parties whose products or services ALM feels may be of interest to you. Many of ALM’s subscribers find these e-mail promotions valuable, whether they are shopping for merchandise, taking advantage of special offers, or purchasing unique services. If you prefer not to have your personal information shared with select third parties, please see the “Opting Out” provision below. ALM also shares the non-personal information it gathers in a compiled format with advertisers and other partners in order to help advertising networks deliver more relevant advertisements through their ad networks. The information may identify your professional biographics and allows Bizo advertisers to display professionally relevant advertising on our pages. The Bizographic Targeting Network (Bizo) is one such network in which ALM participates. Service Providers: ALM may contract with other companies to provide certain services on its behalf, including credit card and billing processing, shipping, e-mail distribution, list processing and analytics or promotions management. Under such circumstances, ALM shall only provide such third party with the relevant information required to perform their services. These service providers are restricted from using any data received from ALM for their own marketing purposes.

Personal information about you as an individual subscriber or registrant may be shared, regardless of your “opt-out” status, in the following instances:

Compliance with Law: ALM may release information if it is required to do so by law or in the good-faith belief that such action is necessary to: (1) comply with the law or comply with legal process served on ALM; and (2) protect and defend the legitimate business interests, rights or property of ALM, its users, advertisers, customers, sponsors, advertisers or affiliates.

Vendors: ALM may on occasion use third-party vendors to assist it in performing its business functions, such as mailing statements to subscribers, editing user lists, processing data and payments, and providing customer service. Personal information may be shared with these businesses or individuals to allow them to perform their assigned functions, but is limited to that information needed to perform the assigned function, and may not be used for any other purpose.

Organizational Changes: Should ALM undergo a sales, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation, ALM’s accumulated customer information will be treated as an asset and, like other business assets, subject to transfer to or acquisition by a third party.

Customer Requests for Personal Information: Upon your request, ALM will provide you with its record of the personal information you gave ALM at registration. For security reasons, this information will only be sent to the e-mail address on file for the subscriber ID associated with it. With respect to corporate or law firm accounts, aggregated or individual user history may be shared with the account holder, upon request.

Correspondence with ALM: If you send ALM personal correspondence, such as e-mails or letters, or if other users or third parties send correspondence to ALM about your activities or postings on the Website, ALM may collect such information into a file specific to you. All submissions become property of ALM.

THIRD PARTY PARTNERS AND LINKS TO OTHER WEBSITES

ALM is not responsible for the content or the privacy policies of websites to which it may link. This policy applies solely to information collected by ALM.

ALM Provider Partner Products & Services: While visiting the ALM site, you may decide to purchase a product or service through one of ALM’s provider partners whose services are promoted or advertised on the site. If you do so, you will be acting under the guidelines of the third-party provider’s privacy policy, if it has one. ALM cannot make guarantees or warranties as to the nature of a third party’s use of your personal information.

PROTECTION OF YOUR INFORMATION

Data Security: To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, ALM has put in place appropriate physical, electronic, and managerial procedures to protect the information ALM collects online, including SSL security for credit card submissions. Detailed information about SSL is available online through your chosen browser.

A SPECIAL NOTE ABOUT CHILDREN AND NON-U.S. USERS

The ALM site is directed to adults and not directed to children under the age of 13. ALM asks that minors not submit any personal information. ALM complies with the Children’s Online Privacy Protection Act and does not permit registration by, and will not knowingly collect personally identifiable information from, anyone under 13.

All users, including those users who access the ALM site from a country other than the U.S., agree that the laws of the State of New York shall govern any dispute, including those disputes arising from ALM’s use of personal information or otherwise relating to privacy, as specified in the Terms and Conditions of Use.

OPTING-OUT, CORRECTIONS AND CANCELLATIONS

E-mail: Upon registration for any of the Online Services, you have the opportunity to set your preferences to receive e-mails regarding services updates, newsletters and/or product or service promotions. Any recipient of e-mail notices may opt out of receiving them at any time. To opt out of receiving e-mails, please e-mail your request to customercare@alm.com or follow the unsubscribe instructions located near the bottom of each service update, newsletter or promotional e-mail.

Postal Addresses: ALM collects postal mailing address information from you so that ALM may fulfill the orders you submit and to inform you of ALM programs, products and services in which you may be interested. You have the right to opt out of receiving postal mailings from ALM. If you do not wish to receive postal mailings from ALM in the future, please send an e-mail to customercare@alm.com. ALM selectively makes its postal mailing address list available to ALM affiliates whose products or service offerings may be of interest to you. If you do not wish for ALM to provide your mailing information to ALM affiliates, please specify this in an e-mail to customercare@alm.com

Corrections/Cancellations: If your personal information is incorrect, ALM will correct such information upon request. Please e-mail your corrections to customercare@alm.com. Upon request ALM will cancel your registration, thereby removing you and your personal information from the ALM database. Please direct your request to customercare@alm.com.

Under the California “Shine The Light” law, California residents may opt-out of ALM’s disclosure of personal information to third parties for their direct marketing purposes. As detailed above, any California resident may choose to opt-out of the sharing of such personal information with third parties for marketing purposes at any time by submitting a request in writing to the ALM Customer Service mailing address noted above or by directing such request to customercare@alm.com. For the avoidance of doubt, it is important to understand that this opt-out shall not prohibit any disclosures made for non-marketing purposes.
